Ya sea un apartamento vacacional en Cartagena, una finca a las afueras de Medell\u00edn o una oficina en Bogot\u00e1, el mercado inmobiliario en Colombia es tan atractivo como diverso.<\/p>\n\n\n\n<p>Sin embargo, el sistema legal colombiano tiene sus propias reglas, y pasarlas por alto puede convertir una inversi\u00f3n so\u00f1ada en una batalla legal costosa . Aqu\u00ed te contamos lo que todo comprador extranjero debe saber antes de firmar.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Paso 1: Verificar el status legal de la propiedad<\/strong><\/h3>\n\n\n\n<p>El primer paso es consultar el <strong>Certificado de Tradici\u00f3n y Libertad<\/strong>el documento oficial de propiedad y grav\u00e1menes que va a confirmar:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Qui\u00e9n es el due\u00f1o de la propiedad<\/li>\n\n\n\n<li>Si existen hipotecas, embargos o limitaciones al ejercicio de la propiedad<\/li>\n\n\n\n<li>Restricciones (protecci\u00f3n patrimonial, derechos de usufructo, procesos judiciales)<\/li>\n<\/ul>\n\n\n\n<p>\ud83d\udca1 <strong>Consejo:<\/strong>Nunca dependas de la palabra del vendedor, solicita un certificado al d\u00eda directamente de la <em>Superintendencia de Notariado y Registro<\/em>, disponible en l\u00ednea <a href=\"https:\/\/certificados.supernotariado.gov.co\/certificado\"><strong>aqu\u00ed)<\/strong><\/a><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Paso 2: Hacer un estudio de t\u00edtulos<\/strong><\/h3>\n\n\n\n<p>Un <strong>estudio de t\u00edtulos<\/strong> es un proceso de auditor\u00eda legal del historial de propiedad, normalmente cubriendo los \u00faltimos 20 a\u00f1os. Su objetivo es asegurar:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Que todas las transferencias anteriores fueron v\u00e1lidas<\/li>\n\n\n\n<li>Que no existan vac\u00edos o irregularidades<\/li>\n\n\n\n<li>Que ning\u00fan tercero (herederos, copropietarios, c\u00f3nyuges) pueda reclamar derechos m\u00e1s adelante<\/li>\n<\/ul>\n\n\n\n<p>Saltar este paso, o pensar que basta con traducir documentos en Google, es uno de los errores m\u00e1s comunes que cometen los extranjeros. Como dice el refr\u00e1n: <strong>\"el que tiene para el whisky, tiene para el hielo\";<\/strong> lo mismo aplica aqu\u00ed: si vas a comprar una hacienda espectacular, tambi\u00e9n deber\u00edas poder pagar nuestros honorarios (sin compromiso, y de hecho son p\u00fablicos, disponibles <a href=\"https:\/\/colombialegaledge.co\/es\/pricing\/\"><strong>aqu\u00ed)<\/strong><\/a>) <\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Paso 3: Entender la regulaci\u00f3n cambiaria<\/strong><\/h3>\n\n\n\n<p>Los extranjeros deben registrar su inversi\u00f3n ante el Banco de la Rep\u00fablica<em>Banco de la Rep\u00fablica<\/em>mediante una declaraci\u00f3n cambiaria. El vendedor colombiano normalmente no sufre consecuencias, as\u00ed que puede que ni siquiera lo sepa.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Paso 4: Firmar la promesa de compraventa<\/strong><\/h3>\n\n\n\n<p>Antes de firmar la escritura, las partes usualmente firman una <strong>promesa de compraventa<\/strong>, estableciendo:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Precio y m\u00e9todo de pago<\/li>\n\n\n\n<li>Fechas de pago<\/li>\n\n\n\n<li>Obligaciones del comprador y del vendedor<\/li>\n\n\n\n<li>Penalidades por incumplimiento<\/li>\n<\/ul>\n\n\n\n<p>Este contrato deber\u00eda ser redactado (o por lo menos revisado) por un abogado colombiano, ya que las promesas de compraventa mal escritas pueden dar lugar a disputas y vac\u00edos.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Paso 5: Formalizar la compraventa ante un notario<\/strong><\/h3>\n\n\n\n<p>La transferencia final exige firmar la <strong>escritura p\u00fablica<\/strong> ante notario.
