Case study – AirBnb

Where It All Starts

Mary, a successful real estate investor, finds a condo at a great price in Bogotá. She thinks its a great investment to rent on AirBnb. The owner convinces Mary to acquire the condo ASAP, leaving no time for her to research.

Conflict

It turns out the HOA forbids owners to list their condos on AirBnb, and one of the requirements issued by the National Tourism Registry is an express HOA permission allowing short-term rentals.

Outcome

Not only does Mary face the trouble of not being able to list her new condo on AirBnb, but the property has legal trouble and the “owner” was not even the owner in the first place, so she was, indeed, scammed out of US$ 500.000

As Mary’s attorneys, this case breaks our hearts because we can’t undo our clients’ honest mistakes. Always remember: Colombia is a fun and lovely destination, but that doesn’t mean rules aren’t strict. Regulatory Compliance at every level is extremely stringent in Colombia, leaving room for no mistakes. You can end up tied in a very complicated and expensive matter if not properly advised.
